General Conditions The offer presents a quiz game for the determination of 120 finalists who participate in the Off Line- winning game (final lap). In the final lap of the last 120 finalists 100 prices can be won. The First Price is a one-family-house. The remaining prices are detailly described on the home page on page “prices”. The skeleton of the quiz game is based on the limit of 48.000 on line registrations. For the possi-bility for registration and participation in the Off Line-winning game the amount of € 19,-- has to be payed. The game consists for the player mainly of four ( 4 ) steps : 1. : the application, 2.) : to be put On Line, 3.) : the qualifying for the Off Line – winning game, 4.) : the participation in the Off Line – winning game (final lap). To determine the 120 finalists for the Off Line – winning game , questions outof the field of popular knowledge with several answers are asked, where as only one of the presented answers is correct. This system is well known from popular TV-quiz formats (Multiple Choice). To answer each question, in the beginning 60 seconds, later on 30 seconds are granted. Having answered correctly, the next question is presented. During the first lap little helps are integrated to get the necessary routine and training. Advice for participants outside Germany : The participantion in the game with money pay down and acceptance of prices is subject to the law regulations of the different home countries. This platform is neither an offer, an instigation nor an invitation of the organizer for the use of the game in countries, in which such activities are prohibited. The use of and the participation in this game platform therefore is subject to the responsibility and guarantee of the participant accordingly to the law regulations in his/her home country. 1. Game rules a) Run of the game in general After registration for the quiz game the participants receive by email a participation ident code and a request form for a non recurring participation payment (fee) of 19,-- €. Until the closure of the Off Line winning game (final lap), the participation payment (fee) is only due o n c e. The participation ident code for each participant will be proceeded during registration and reserved for 10 (ten) working days. In case of the payment ist not remitted and received within 10 (ten) working days (bank working days), the participation ident code will be cancelled. After receipt of the payment the participants will receive via email a payment confirmation, they will have from now on free internet access to the quiz game, in consequence they can now take part in the first lap. For qualification in the final lap the participants have to take part within 2 (two) weeks. If this should not occur within the a.m. schedule, the participating person will receive a urging invitation and a further period of 8 (eight) days. If then no participation takes place, the player`s data are deleted. A repayment of the registration fee is excluded. The participants do not enter into any other obligations. Totally 48.000 registrations / applications will be accepted. The bank account of the organizer will be closed while reaching a number of 48.000 remittances, no further applications / reservations will be accepted anymore. All later payments (in case of overlapping of the remittance with the closing of the account) will be returned at no charge. In any case the time of receipt (chronological order) on the bank account is relevant. The public final lap of the quiz game within the limits of an Off Line – performance will be organized and proceeded afterwards within a period of approx. 4 (four) weeks. If the total number of 48.000 participations should be achieved earlier, the public final lap will be performed adequately earlier. All informations / news as well as deadlines will be published at due time in the homepage under ”Actualities”. b) Run of the internet game Out of the 48.000 reservations with access to the quiz game the 120 finalist will be determined in several laps. One lap generally consists of 10 - 15 different questions. The questions will be distributed out of a question pool for every participant. The participants have to answer questions which come out of different fields of general education including answers of which only one is correct (Multiple Choice as used in popular TV-quiz shows ). During the game, questions become more difficult and the answering time for each question decreases from 60 to 30 seconds. The candidate who has answered all questions correctly during one lap reaches the next lap with further questions. If a quest-ion is not or wrongly answered, the candidate is excluded from the game. The game will be played as long as 120 candidates remain for the final lap. The last game sequence before the final lap will be played that way that a candidate who gives wrong answers is not excluded immediately from the game. The number of mistakes of each candidate then is used to define the 120 participants who remain and are qualified for the final Off Line – winning game which is to say that those who have the fewest rate of errors are most qualified. The deadline for the final lap will be published in the homepage under ”Actualities” at least 14 days before the final lap. The finalists additionaly will be informed by email. The finalists continue their play in the final lap for the 100 quiz prices. The last remaining partici-pant, the one who remains the longest time in the game and knows the most becomes the winner of the first prize and is then owner of a 1-family house. Candidate twentyone (21) who leaves the final lap receives prize N° 100, candidate twentytwo (22) prize 99 and so on. The final lap is carried out at the place of the event and takes place in public under the observation of a notary. Your personal presence is necessary. The place of event will be determined by the organizer. All participants play at the same day at the same time, one after the other or in groups. Travel charges by train 2nd class will be carried by the organizer. The technical equipment and all questions are for all participants identically which guarantees transparancy and equal chances. This can be realized as a LAN-party with several PC´s or by simple control panels or another solution with the possibility of 4 different choices. It is guaranteed that the answers will be transferred without any delay. To answer each question, 30 seconds are left. 2. Prizes – Profits In the page ”Prizes / Profits” you will find a detailed description of the objects. The prizes will be handed over to the winners directly after the final lap as far as this is possible or will be held ready for pickup or – after arrangement – will be despatched to the winner against freight invoice. If a deli very should not be possible or the freight - charges should be excessive, a voucher / coupon or a comparable document will be handed over. The transfer of the ownership of the 1-family house (1st.prize) will be handled immediately by a notary.. Of each participant, the organizer needs for the proceedure of the game of skills some personal data. The participant agrees that these data are required, proceeded and if this should be necessary used for the final lap of the Off Line – game. For the processing of the game, the organizer is authorized to use these personal data, respecting the German data protection laws (TMG, BDSG), respectively to let them be proceeded for order data processing. All informations, data and emails of the paricipants will be handled strictly confidential, with highest accuracy and security and will not be passed to a third party. The participant declares expressively to the organizer his/her agreement to use the gained data for automate supported processing. Moreover, the participant declares expressively that the data can remain in possession of the organizer and be processed, as far as this should be neces-sary for administrational purposes. A responsibility for the organizer for illegal abuse or initiated abuse of these data by a third party is excluded. A claim for damages of the participant or a third party against the organizer directly or indirectly outof the relationship to the gained data is excluded. 4. Reservation (inscription) fee For the possibility of participation in the Off Line game (final lap) a fee of 19,-- € will be invoiced. After reservation you will receive an appertaining invoice by email. After the receipt of the payment, the participant immediately has free access to the game for qualification for the final lap. To achieve an undisturbed run of the game for all participants, the time schedules have to be kept. Travel charges within Germany in connection with an eventual participation in the final lap will be refunded. Other eventual charges which might result in the participation in the final lap have to be payed by the participant. 5. Responsibility of the organizer The organizer cannot guarantee the uninterrupted run (e.g. hacker attack, DOS-attack) the uninterrupted use and availability ( power breakdowns, Acts of God) of the offered game. The organizer will try in a reasonable scale to correct errors and problems to protect the participants against disadvantages. Moreover, the organizer excludes the responsibility for illegally procured personal data of the players by a third party (e.g. by a criminal act, especially in the field of data espionage). Also for data transfer delays or technical failures of the system the organizer is not responsible. Therefore the participant cannot interpret due to technical problems any claims against the organizer. Should the participant been thrown out of the run of the game due to these circumstances by furnished proof , the organizer will enable the player to continue the game as far as this is possible. A further responsibility is excluded. Intensional interruption of the data exchange leads to disqualification. The organizer is not obliged to examine data which have been made available by the participant. The offered game of skills is available for the players at the last state of the art. To avoid an overload of the system, the access to the system is limited to 500 at the same time. In this case, the participant is informed, that the website will be available in a few minutes so he / she can try again. The technical configuration of the participant´s computer or the device which is used for the connection with the website is exclusively under the responsibility of the participant. 6. Final regulations German law is exclusively in force. Should one or several clauses of these General Conditions should be partially or completely invalid or should become invalid, this does not affect in any way the remaining paragraphs. Instead of the invalid or having become invalid regulations the actual regulations by German law become valid. This is also valid in case of the fact that the Conditions for Participation are not completely. Changes of the Conditions of Participation will be published on the website. The Conditions of Participation, as described before, have changed due to a conceptional modification on February 17, 2010. Reservations which have taken place before that change are automatically included in the new game concept. The participation and winning possibilities remain the same.
